1. Agreement to Terms

By accessing or using the BlaBlaAHA! app and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Func Main Ltd (Company number 10480912), referred to as "we", "us", or "our" throughout these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Account Registration

You may create an account using Apple Sign-In or use the Service anonymously. You are responsible for maintaining the security of your account credentials. Each person may maintain only one account. You must not share your account or allow others to access it.

You agree to provide accurate information and to keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

Certain features of the Service require a paid subscription, which is processed through Apple's In-App Purchase system. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

You can manage or cancel your subscription through your Apple ID account settings. Refund requests must be directed to Apple, as all payments are processed by Apple. We do not have the ability to issue refunds for App Store purchases.

5. AI-Generated Content

The Service uses artificial intelligence to generate learning content, including audio, transcripts, and related materials. AI-generated content is provided for educational and entertainment purposes only and does not constitute professional advice of any kind.

We do not guarantee the accuracy, completeness, or reliability of AI-generated content. You acknowledge that AI-generated materials may contain errors and should not be relied upon as a sole source of information.

All content generated by the Service's AI systems — including lesson scripts, audio files, and transcripts — is owned by us. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use AI-generated content within the Service for your personal, non-commercial use, subject to these Terms. This licence does not permit you to redistribute, sublicence, or commercially exploit AI-generated content outside the Service.

6. User Content and Conduct

You are responsible for all content you create or share through the Service, including usernames, display names, profile information, and lessons. You agree not to:

• Use offensive, misleading, or impersonating usernames or profile content.
• Post or share content that is unlawful, harmful, threatening, abusive, or harassing.
• Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
• Use the Service to violate any applicable law or regulation.
• Use automated systems or bots to access the Service without our prior written consent.

7. Social Features

The Service includes social features such as user profiles, follow relationships, and shared lessons. The visibility of your profile and content depends on your account privacy settings (public or private).

We reserve the right to moderate, remove, or restrict any user content or social interactions that violate these Terms or that we determine, in our sole discretion, to be harmful or inappropriate.

8. Intellectual Property

All intellectual property rights in the Service, including its design, features, code, and branding, belong to us or our licensors. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain ownership of any content you directly input into the Service, such as lesson titles, descriptions, and profile information. By using the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display your input content solely for the purpose of operating and providing the Service.

For the avoidance of doubt, all AI-generated content (including scripts, audio, and transcripts) produced by the Service remains our intellectual property, as set out in Section 5. Your licence to use such content is limited to personal use within the Service.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to the Service or other users.

You may delete your account at any time by contacting us at legal@blablaaha.com. Upon termination, your right to use the Service ceases immediately.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
